What are you talking about?
You are not entitled to a refund after you have downloaded your purchase and you have received it. Bans or whatever have nothing to do with it.

Since Graal has no TOS you can assume either A) your download is non-refundable after purchase, although Apple's TOS protects you if you never received your purchase or B) Eurocenter refunds on a case by case basis.

Rufus is right. Let me break this down for you guys.

The Application Provider, and its licensors, reserve the right to change, suspend, remove, or disable access to any Services at any time without notice.

A "ban" is a form of disabling access to the service. The "Service" provided is being able to log into Graal and play. They have the right to prevent you from doing so, without notice(they can ban you for anything without a warning, and do so immediately)

In no event will the Application Provider be liable for the removal of or disabling of access to any such Services.

They aren't liable for banning you, if a stupid gp bans you for beating his friend in a spar or something Stefan/Unixmad aren't accountable for it.

The Application Provider may also impose limits on the use of or access to certain Services, in any case and without notice or liability.

If they decide to change it so you only get spar 5 times day without buying spar tokens with real money or something stupid out of nowhere, you can't go and ask for a refund because they have the right to impose limits. You can't ask for a refund if you get muted/gagged or whatever either.

Delivery = download. Failed delivery means the product failed to download after you purchased it(for whatever reason). Once the game is downloaded that part is no longer applicable.

Then shouldn't it say download, and not delivery? Unless they provide their definition of delivery, I'm assuming it's the definitions I can find with reliable sources.

Downloading is just a form of delivery:

noun, plural de·liv·er·ies.
1. the carrying and turning over of letters, goods, etc., to a designated recipient or recipients.
2. a giving up or handing over; surrender.
3. the utterance or enunciation of words.
4. vocal and bodily behavior during the presentation of a speech: a speaker's fine delivery.
5. the act or manner of giving or sending forth: the pitcher's fine delivery of the ball.

First one could probably be applicable in this day and age(language does evolve). Even if it didn't, the 5th definition most definitely fits.

Anyways it's legal mumbo-jumbo, lawyers chose those words for a specific reason.  

I don't think hes saying it's RIGHT, hes saying it's happened. Argue definitions all you want.

btw, i was mocking him. This thread is useless because clearly OP is just trying to start a commotion. iTune's ToS only applies to failed downloads. OP needs to stop finding faults where there is none.
