I recently discovered that GraalOnline on the iPhone does not have its own Terms of Service and must comply to the iTunes Apple Store Terms and Conditions.

Section A of the iTunes Store Terms and Conditions:
"If a product becomes unavailable following a transaction but prior to download, your sole remedy is a refund. If technical problems prevent or unreasonably delay delivery of your product, your exclusive and sole remedy is either replacement or refund of the price paid, as determined by Apple."

If you are banned from any iGraal server you can contact the app store support and claim that your service has been discontinued for reasons not stated in an agreed ToS and that your investments into the game have been made useless. Request a full refund including in-app purchases. The publisher (Eurocenter) will have to refund you 100% of your purchases.  

Uhh, that is not what that means at all.  

Then why has it worked?

This speaks for itself. There is nothing here that is related to being banned or a loss of in-app purchases. A ban, by its very nature, requires you to have downloaded the application. This is addressing applications that are removed from the iTunes platform post-purchase.

From the same Terms and Conditions:

All In App Purchases are deemed App Store Products, and In App Purchases made within Third-Party Products are deemed Third-Party Products, and treated as such, for purposes of these terms and conditions.

Not arguing that. I should have just said that it has been done (not by myself) recently for the reason stated.

Also, Graal Mobile Servers DO NOT have a terms of service, anywhere.

Assuming this is the definition they are implying

Delivery = download. Failed delivery means the product failed to download after you purchased it(for whatever reason). Once the game is downloaded that part is no longer applicable.
