Don't know, probably because they are not refuting claims. All I do know for certain is:

                     If a product becomes unavailable following a transaction but prior to download, your sole remedy is a refund.

 This speaks for itself. There is nothing here that is related to being banned or a loss of in-app purchases. A ban, by its very nature, requires you to have downloaded the application. This is addressing applications that are removed from the iTunes platform post-purchase.
