They would need evidence that the hat generated money, which would be fairly easy, but it wouldn't be anywhere near enough money to sue someone. In all honesty, if they ever found out about something like that and they cared for some crazy reason, they would just have lawyers send a letter saying to remove it. Everyone talks about suing people like it happens as easy as snapping a finger. It can, but it doesn't.
